ARCHIVED - Almeria nudist war comes to an end as judge rules residents are allowed to wear clothes
For years, residents of the Vera Playa community were banned from using communal areas unless naked
One of the strangest cases to emerge from Andalucia, which has been raging on for more than a decade, has come to an end as the Supreme Court has ruled that dissenting members of a nudist resort in Almeria can’t be forced to walk around in the buff.
Some 495 homes make up the ‘Natura World’ urbanisation in Vera Playa, a gated residential community that embraces the nudist lifestyle. However, over 10 years ago a war broke out between the naturalists, who make up 80% of the housing estate and the ‘textiles,’ who account for the other 20%.
Over these long years several judges have ruled in favour of the naturist community’s right to impose these rules since "the area, in which the urbanisation is located, has enjoyed great prestige among the nudist-naturist community from all over Europe for decades”.
“Several areas of the beach have this orientation”, one such court pointed out, adding that “the communities of neighbors and urbanisations respect, welcome and encourage naturism, and there are hotels, restaurants and beach bars that, for many years, have allowed these practices, as well as by all residents, institutions and administrations".
"Coexistence and harmony," the decisions of the lower courts concluded, "have always existed, up to the present day."
But these decisions have finally been overturned by the Supreme Court, which ruled that forcing the textiles to practice nudism against their will was a violation of their fundamental rights to privacy and freedom of choice.
The high court has ordered the community to lift the nudity requirement in common areas and has ordered it to pay 1,000 euros in compensation to each of the plaintiffs.
