ARCHIVED - Andalucia cops avoid jail in favour of sexual education course after being found guilty of rape
The 18-year-old victim from Estepona opted to avoid reliving her attack at a trial

Two Estepona Local Police officers have been sentenced to two years in prison for a serious sexual assault on an 18-year-old back in 2018, but the pair won’t serve a minute behind bars. The victim was raped in exchange for the officers “forgiving” a traffic ticket and to avoid the trauma of reliving her attack in open court, the young woman reached a plea deal with the defence lawyers.
Instead, the Court of Malaga has ruled that the former officers, Juan Carlos Galván and Vicente Peña, must undergo a sexual re-education course and pay 80,000 euros in compensation to the victim.
The shocking assault occurred on June 10, 2018 when the woman was travelling to Malaga by car with her friend and boyfriend. The trio was stopped at a police checkpoint and the young man who was driving admitted to having consumed alcohol. Strangely, the officers told the youngsters to park up the vehicle and get a taxi home, and said that they would drive it back for them when their shift finished.
Not long after, the Police officers arrived at the victim’s home with the car and asked to be invited in. Once inside, the court heard that one of the agents asked the three civilians: “Well, how do you start an orgy?”
The defendants then reportedly tried to convince the young woman to take cocaine and have a threesome with them.
“How many girls would like to be in your place and get involved with two policemen at the same time,” the officers asked their victim.
She refused their advances but the men undressed the woman; one of the agents put his finger in her vagina while the other penetrated her without using a condom. Seeing what was happening, the victim’s friend fled the house and called for help.
The Prosecutor’s Office originally requested a sentence of 30 years in prison for each of the policemen, who were later sacked. The private prosecution had raised the request to 33 years by adding a crime against public health because they maintain that, in addition to raping her, the officers forced their victim to consume cocaine.
