Andalucia passes law to limit holiday rentals
From February, town councils throughout Andalucía will be allowed to set a cap on the number of holiday apartments
In an effort to crack down on illegal holiday rentals and to prevent residential areas from being overrun with tourists, the Junta de Andalucía has passed a law that will allow local town halls to limit the maximum number of vacation apartments allowed.
From February 22, local governments will be able to decide how many holiday lets are allowed in a particular building, neighbourhood or zone “for reasons of general interest”.
Owners of existing holiday rentals will be given a year to bring their apartments up to scratch, and they’ll have to let the council know within six months how often the property is available to tourists. If they fail to notify the authorities within this period, it will be assumed the property operates as a holiday home all year round.
The Minister of Tourism, Arturo Bernal, explained that the new decree aims to improve the regulation of the more than 116,000 homes for tourist use which currently exist in Andalucía.
According to the latest data, there are 4,778 vacation rentals available in Málaga city centre, while only 429 children under the age of 16 are registered in the same area. That means there are 10 tourist apartments for every youngster living within the limits of the centre.
Real estate agent Martin Treasure, who is a member of the Advisory Board of the Association of International Property Professionals, said: “The Junta have taken a much tougher regulatory stance to registration and oversight of short term rentals. That’s no bad thing as nobody wants visitors to spend thousands on a sub-optimal experience.”
