ARCHIVED - Gibraltar man kicked out of Spain under post-Brexit rules
The British citizen was ejected from Spanish soil for having committed a crime in the past
The Gibraltar border has witnessed the first expulsion of a British citizen upon entering Spanish territory under the new post-Brexit Schengen regulations. The man was returned from Spain to the Gibraltar side of the border this week because he had been involved in a crime in the past.
Schengen regulations require the expulsion of any person who has committed a crime from the territory of the countries that make up the Schengen area (which includes Spain and much of Europe) for a certain period of time and, for this reason, the man was returned to British soil in Gibraltar this Tuesday October 18.
Since Brexit, the UK is no longer part of the Schengen area, but the man in question had been in prison since that time and so perhaps was unaware that the rules had changed and he couldn’t enter Spain anymore.
This is the first time such an expulsion has been necessary on the Gibraltar border under the new post-Brexit rules.
Spanish police flagged up his attempt to cross the land border from Gibraltar to the Spanish town of La Línea de la Concepción (Cadiz), and ejected him from Spanish soil. He is now banned from entering Spain and any other Schengen country.
Under EU law, this type of expulsion has a fixed duration, which cannot exceed five years and is usually set at three. However, if the person re-enters Schengen territory and is expelled again, this period starts again from zero.
