Expat living abroad? Why a UK lasting power of attorney still matters
Elysium Wealth Advisors highlight the key estate planning document many expats in Spain forget
For many British expatriates, estate planning begins and ends with preparing a Will. While a Will is undoubtedly essential, it only takes effect after death. One of the most overlooked, but equally important, legal documents is a UK Lasting Power of Attorney (LPA).
An LPA allows you to appoint someone you trust to make decisions on your behalf should you lose the mental or physical capacity to manage your own affairs. Without this legal authority in place, even close family members may be unable to access bank accounts, manage investments, deal with property or make financial decisions on your behalf without first applying to the Court of Protection, a process that can be both time-consuming and costly.
This is particularly relevant for UK nationals living overseas who still retain financial ties to Britain. If you own UK property, maintain UK bank accounts or investment portfolios, receive a UK pension or expect to return to the UK in the future, a UK LPA should form an integral part of your overall estate planning strategy.
Many expatriates assume that legal documents prepared in their country of residence will automatically be recognised in the UK. Unfortunately, this is not always the case. A UK LPA provides certainty that your affairs can be managed efficiently under English and Welsh law if the need arises.
Effective estate planning is about protecting both your assets and your loved ones. While a Will safeguards your family's future after your death, a Lasting Power of Attorney protects you during your lifetime by ensuring your wishes can be carried out if you are unable to make decisions yourself.
Planning ahead today can spare your family significant stress, delay and unnecessary legal expense tomorrow.
