ARCHIVED - Marbella father granted custody as mum lives in area that is too remote
The Costa del Sol judge has ruled that the Andalucía town will offer the little boy more opportunities
In a ground-breaking ruling, a judge has granted custody of a child to the father residing in Marbella over the Galician mother on the grounds that the dad’s home town offers more in the way of “a happy environment”. The mother, who lives in a remote part of Galicia in far north-western Spain, will only be given joint custody if she chooses to move to Málaga.
The ruling has described Marbella as a “cosmopolitan city” with "a good hospital" and "all kinds of schools to educate a child, public or private".
The judge insisted that living on the Costa del Sol would offer more opportunities for the development of the child which wouldn’t be available in the tiny village in Galicia to which the mother has moved.
According to the judge, the Galician town where the mother resides is "far from everything" and there are no "job options" there. The mum is actually originally from Galicia but moved to Marbella for work, which is where she met the child’s father and where the little boy was born. She returned home when they separated and filed for joint custody.
Claudia Traba, the woman's lawyer, plans to file a formal complaint with the disciplinary commission of the General Council of the Judiciary for the attitude of the judge.
