Brit and Irish Marbella shooting suspects do a runner
The two wanted men disappeared after being released on bail by the Málaga courts
There’s more embarrassment for the Costa del Sol judicial system this week following the disappearance of two suspects, an Irishman and a Briton, released on bail after being arrested for a shoot-out at a Marbella restaurant.
Darren H and Gerrard S, both linked to organised crime in Spain and their home countries, allegedly opened fire fifteen times on a restaurant in broad daylight on March 11. Incredibly, nobody was injured, and the pair fled the scene.
They were eventually picked up on March 25 by the National Police and jailed two days later after questioning. However, barely a month later, the Provincial Court of Málaga released them on bail with the agreement that they would surrender their passports and appear before their local judge on the 1st and 15th of each month leading up to their trial.
But the suspects failed to show up on the May 1 date and a search and arrest warrant was issued.
This is yet another awkward situation for the Málaga courts after the disappearance of a notoriously dangerous mafia boss while also out on bail. Karim Bouyakhrichan, the most wanted criminal in Netherlands, was provisionally released in March and promptly disappeared without a trace. He hasn’t been seen since April 1.
During the first court appearance of the Irish and English suspects, the lawyers argued that their clients’ rights to access all of the documentation pertaining to their case had been violated, which prevented them from fully exercising their right to a defence. For this reason, the court decided to release them on April 22.
According to official sources, the men, who are both in their 30s, stand accused of attempted murder, serious threats, illegal possession of weapons – a pistol was found at the home of one of them, although a ballistics study will have to clarify if it was the same one that was used in the Marbella restaurant shooting – falsification of documents and violation of the Immigration Law.
